The German national law on designation rights is now summarised[1] in the Trade Mark Act (MarkenG). This not only contains the national provisions on trade marks and procedural provisions under trade mark law implemented in accordance with the requirements of the MMR. Rather, the MarkenG also regulates the only indirectly harmonised law of company designations, work titles and geographical indications.
The Trade Mark Ordinance (Markenverordnung, MarkenVO) contains implementing provisions of a formal nature for the MarkenG, which roughly correspond to the EUTMIR and the DV for the EU trade mark. Finally, provisions on fees for Germany can be found in the Patent Costs Act (Patentkostengesetz, PatKostG).
